Demons are there. Christ said some human beings go to hell, and that Judas was damned. The existence of hell, that persons are there, and that it is eternal are dogmas of the Church. Therefore, to believe hell is empty is to deny the dogma of the Church, which is by definition heresy. And to repeat the same heresy over and over in public demonstrates manifest formal heresy, which results in an automatic excommunication, and if said person was holding an ecclesial office, they would automatically lose their office according to the current Code of Canon Law.
